Terms of Service
Last updated: October 7, 2026
The short version
- Hosting plans are yearly subscriptions in Canadian dollars, paid through Stripe. Domains are billed separately.
- Plans renew automatically each year. We email you 30 days before each renewal, and you can cancel anytime.
- You can get a full refund of a hosting plan within 72 hours. Domain registrations can’t be refunded once registered.
- Nothing in these terms takes away your rights as a consumer under the law that applies to you.
1. Who we are
Digital Market Club is the business name of Nicholas Gagnon, a sole proprietor in Ontario, Canada. In these terms, “we”, “us” and “our” mean Nicholas Gagnon, trading as Digital Market Club. “You” means the person or business that uses our website or buys our services.
We are reachable by email only, at hello@digital-market-club.com.
2. These terms
These terms apply when you use digital-market-club.com or buy any of our services. The following policies are part of these terms:
If you register a domain name, the registrar and registry terms described in section 8 also apply.
Nothing in these terms limits or excludes any right you have as a consumer under applicable law, including the consumer protection laws of your province. If a part of these terms conflicts with those laws, the law applies and the rest of these terms stays in effect.
3. Our services
- Hosting plans include web hosting and email mailboxes. They run on servers provided by OVHcloud. Each plan includes the features described on our website when you buy it.
- Domain registration is provided through NameSilo, an ICANN-accredited domain registrar. Domains are billed separately from hosting plans.
4. Your contact details and account
- Give us accurate contact details and keep your email address up to date. We send renewal reminders, receipts and important service notices to it.
- Keep your passwords, including mailbox passwords, private. You are responsible for activity that happens using your credentials.
- You must be legally able to enter into a contract. If you buy for a business, you confirm you are allowed to accept these terms for it.
5. Prices and payment
- All prices are in Canadian dollars (CAD).
- Hosting plans are yearly subscriptions, paid in advance. The monthly figure on our website is the yearly price divided by 12, for comparison. You are charged the full yearly price when you subscribe and at each renewal.
- Payment is processed by Stripe through Stripe Checkout. Your card details are entered on Stripe’s secure page and are handled by Stripe only. We never see or store your full card number.
- Domain registrations and renewals are priced and billed separately from hosting plans.
- Before you pay, checkout shows the full yearly price and how renewal works.
- If sales taxes apply, they are shown at checkout before you pay.
6. Automatic renewal
- Hosting plans renew automatically every year, so your website and email keep working without interruption.
- Each renewal is charged to the payment method on file at the published price for your plan at the time of renewal.
- We email you 30 days before each renewal, with the renewal date and price.
- You can cancel at any time before the renewal date to stop the next charge. See section 7.
7. Cancellation and refunds
Our Refund and Cancellation Policy has the details. In short:
- You can get a full refund of a hosting plan if you ask within 72 hours.
- After 72 hours, you can cancel anytime. Your service keeps running until the end of the year you paid for, and nothing more is charged. We don’t give pro-rated refunds for the rest of the year.
- Domain registrations are non-refundable once the domain is registered.
8. Domain names
Registrar and registry terms
Domains are registered through NameSilo. When you register or renew a domain through us, you agree to:
- NameSilo’s Terms and Conditions for domain registration;
- the policies of the registry that runs your domain’s extension (for example, CIRA for .ca); and
- for domain extensions governed by ICANN (such as .com, .app and .dev), ICANN’s Registrants’ Benefits and Responsibilities.
Disputes about who has the right to a domain name are decided under the dispute policy of the domain’s registry. Examples are ICANN’s Uniform Domain-Name Dispute-Resolution Policy for .com and CIRA’s Domain Name Dispute Resolution Policy for .ca.
Accurate contact information (WHOIS)
- Domain registration requires accurate, complete contact details for the domain’s registrant. Keep them up to date.
- Respond to verification requests from the registrar. For ICANN-governed domains, you must respond within 15 days.
- If contact details are false, out of date or not verified, the registrar or registry can suspend or cancel the domain.
- Your domain contact details are shared with NameSilo and the registry as registration requires. Some details may appear in public registration data (WHOIS or RDAP), depending on the registry’s rules and any privacy option available.
Expiry, renewal and redemption
- Domain renewal is separate from your hosting plan renewal.
- You will receive expiry reminders at the domain’s registrant email address before the domain expires. For ICANN-governed domains, these come about one month and one week before expiry, and again shortly after it expires.
- If a domain expires, the website and email that use it can stop working.
- For a limited time after expiry, the domain can usually still be renewed at its normal renewal price.
- After that, many registries hold the domain in a redemption period, which is 30 days for ICANN-governed domains. During that period it can only be restored by paying the renewal price plus a redemption fee charged by the registry and registrar. We tell you the total before you pay.
- After the redemption period, the domain can be deleted and registered by someone else.
- Transfers in and out are subject to the registrar’s and registry’s transfer rules.
9. Hosting and email
- Your website files, mailboxes and other content remain yours. You give us permission to store, copy and process them only as needed to provide the services to you.
- We make backups as described in your plan. Backups help us restore service; they don’t replace your own copies of important files and email.
- Each plan has the limits described on our website, such as the number of websites and mailboxes.
- We may carry out maintenance and security updates. When maintenance is planned and likely to interrupt service, we try to tell you in advance.
10. Acceptable use
You must follow our Acceptable Use Policy. It covers illegal content, spam, security abuse, copyright notices and how to report abuse.
11. Suspension and ending service
We may suspend or end a service if:
- it is used in breach of these terms or the Acceptable Use Policy;
- a payment fails and isn’t resolved;
- there is a serious security risk to you, other customers or our systems; or
- the law or a registry, registrar or court requires it.
When it is reasonable to do so, we tell you why and give you a chance to fix the problem first. We may act immediately when there is illegal activity, an active security threat, or harm to others.
When a hosting service ends, its website files and mailboxes are deleted. Download anything you want to keep before your service ends.
12. Changes to the services or these terms
- We may update our services and these terms.
- If a change affects your rights, obligations or price, we email you at least 30 days before it takes effect. The email explains the change and the date it applies.
- A price change for your plan applies from your next renewal, and the renewal reminder email shows the new price.
- If you don’t agree with a change, you can cancel before it takes effect.
13. Our responsibility to you
- We provide the services with reasonable care and skill. We can’t promise they will always be uninterrupted or error-free, because they depend on networks, data centres and providers outside our control.
- To the extent the law allows, we are not responsible for indirect or consequential losses, such as lost profits or lost business. Our total responsibility for a claim is limited to the amount you paid us for the affected service in the 12 months before the claim.
- These limits don’t apply where the law doesn’t allow them, and they don’t limit any right you have as a consumer under applicable law.
14. Governing law and disputes
- These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
- If you are a consumer who lives in another province or territory, including Quebec, you also keep the protection of the consumer laws of the place where you live. You can bring a claim in the courts there.
- If you have a problem, please email us first so we can try to resolve it.
- These terms don’t require arbitration and don’t prevent you from taking part in a class action.
